DEPOSIT AND PAYMENTS

A 50% non-refundable deposit is required to confirm all orders, with the balance required 2 weeks before the collection date. Payments can be made via Square payment system online or in person, bank transfer or by cash payments. Please note that your booking is not confirmed until the deposit has been received
Payment of this deposit means that terms and conditions have been accepted by the customer in full

Payment in full is required 2 weeks before your event date. Failure to make payment before this time may result in your order being cancelled.

Alterations to the payment schedule must be requested in advance and are at the discretion of Sweets By M

WHOLESALE ORDERS /ACCOUNTS

All wholesale orders must be paid in full prior to collection or delivery.

QUOTES - WEDDINGS AND EVENTS 6+ MONTHS IN ADVANCE

A $100 booking fee is required to secure the date of your booking and is non-refundable. Within 3 months of your event date, your design & order will need to be confirmed with the remaining balance of 50% of the total order paid. The full balance is required 1 month prior to your event date

QUOTES

This quote is valid for 5 days from completion. After this time, if the deposit has not been received there may be changes to the price quoted and availability. Please note that your booking is not confirmed until the deposit has been received. Failure to make payment of deposit without communication after 5 days will result in your quote being cancelled. Prices quotes may differ if payment is not received within this timeframe and Sweets By M reserves the right to alter prices quoted.

The 50% deposit is non-refundable in the event of cancellation 14 days or less prior to collection date. A 100% cancellation fee is required for 7 or less days prior to collection date. Payment of the deposit is confirmation that these terms have been accepted by the customer.

CANCELLATIONS & POSTPONEMENT DUE TO COVID-19 / FORCE MAJEURE

The 50% deposit is non-refundable in the event of cancellation or postponement 14 days or less prior to collection date.
However, where possible, in the event of postponement of your event due to COVID-19, your deposit may be held for a change of date. We will endeavour to accommodate your change of date request wherever possible. In the event of full payment being made, cancellations of less than 48 hours in advance cannot be accommodated

If an unforeseen Covid-19 lockdown is announced, the following options are available:

1. If work on your order has not commenced, a full refund will be provided minus any expenses already made on toppers, custom ingredients, equipment etc.
or else, your payment held and your order postponed for an rescheduled event wherever possible

2. If work on your order has commenced or been completed, your order will need to be collected/delivery arranged. Information will be provided on how to appropriately store your cake/order.

In the unlikely event that Sweets By M is unable to fulfil the order for reasons including, but not limited to, illness, accident, injury or unforeseen circumstances,
Sweets By M reserves the right to cancel the order and provide a full refund of all payment made by you (minus any custom items returned to the customer such as custom toppers) relative to the order with no further compensation be payable to you.
We will endeavour to help find a suitable replacement company for your order, subject to their availability

An administration fee of $50 will be non-refundable in the event of a cancellation and is subject to the discretion of Sweets By M

CHANGES TO ORDERS OR DESIGNS

Changes to orders are able to made until 2 weeks before the collection date. After this time, there cannot be any alterations made to flavours, designs or quantities.
Sweets By M reserves the right to make changes or alterations to product designs & details at their discretion without prior consultation of the customer if it is not possible/practicable. This includes substitutions or modifications where required.

REFUNDS OR RETURNS

Please note that any refunds can only be given provided the cake is deemed inedible for consumption and contact must be made within 24 hours of pickup/delivery. No refunds will be given for change of mind, cancellation without adequate notice, or if cake/order/item is served or tampered with or for damage incurred due to incorrect transport, storage or handling.

The item must be returned to be inspected before any refund will be considered. Refunds will only be processed in the manner in which they were paid and no cash refunds are available.
Processing fees for eftpos transactions will not be included in refunds as per the T&C of Square Inc.

ALLERGIES / DIETARY REQUIREMENTS

Whilst every effort is made to ensure your dietary requirements are catered for, as we are a small home-based kitchen where other products are used, we cannot guarantee that traces of other ingredients can be completely eliminated due to cross-contamination.

It is the responsibility of the customer to inform of any dietary requirements prior to booking an order. Our products may contain traces of gluten, wheat, nuts, dairy,fish, eggs, sulphites and other allergens

SUPERVISION OF CHILDREN WITH SPRINKLES AND/OR TOPPERS

Please ensure children are completely supervised at all times with the consumption of sprinkles, toppers or our products. There may be supports
in your cake to support the structure of items such as cake dowels, straws and wooden rods which may pose a choking hazard if unsupervised.
Sweets By M holds no liability in the event of injury or damage for failure to provide adequate supervision of others with your order

FLOWERS - SILK OR FRESH

Please be aware that flowers both silk/artificial or fresh will have florist tape or other protective products/tapes to prevent them from direct contact with the cake. There may also
be straws, wooden sticks, floral wire or flower spikes in place. Please ensure they are removed completely before serving and consuming your cake

Flower availability varies and is beyond our control and therefore, Sweets By M reserves the right to alter flowers chosen at their discretion with seasonal availability.

Sweets By M will provide flowers using our own suppliers. If the customer chooses to use their own supplier/florist, we will provide information on our requirements to ensure
sufficient product is available for use and that flowers chosen are not toxic.
We are unable to allow any other persons to place items such as flowers on our products and this will void any responsibility of Sweets By M of damage or food safety violations.
No florist or other person will be able to place flowers on our cakes/products, as food safety requirements are to be adhered to at all times.

DESIGN VARIATIONS

Variations in design and colour will occur even in designs which have been repeated. Using a photo for inspiration, we will aim to match as close to your preference as possible but cannot guarantee exact matching due to differences between cake decorators/designers and variations in colour or appearance due to screens/devices. Every item created is individual and we do not replicate items identically and do not guarantee items will be identical to any inspiration photos.

PICKUP

We will not be held liable for any damage caused to the products once they have been provided to you at our premises, or after handing over of goods at delivery

LATE PICKUP

Please note that we schedule our work and deliveries around your agreed pickup/collection time. Late pickups without prior appropriate

notice will be charged a late fee of $10 per 15 minutes after the allocated pickup time if prior notice is not received

COURIER COSTS

Any courier fees are due 2 weeks before your event date and are non refundable in the event of cancellation or postponement within 2 weeks of event

DELIVERIES

Delivery fees are calculated based on distance and time required to set up your event.

Delivery times are estimated however will depend on factors out of our control at times. We cannot guarantee a certain delivery time due to factors such as weather, traffic, road congestion etc.

HIRE OF CAKE STANDS AND TOWERS/DISPLAY TOWERS

Hire of cake stands or macaron/cupcake towers will incur a hire fee and bond, payable upon placing your order.
Hire bond fee will be refunded upon return of tower/stand in it's original condition within 48 hours of collection to Sweets By M premises.
Any damage or non-return will result in bond and/or hire fee being non-refundable. Refund of bond will be returned in the same manner as which it was paid.

PRODUCT DAMAGE

In the event of damaged products due to incorrect storage or transportation, it may be possible to repair the items depending on the circumstances. This will incur an additional fee to cover time, products required to repair the items and any travel incurred. This will need to be paid in full prior to any work being completed

SERVING OF PRODUCTS AND PACKAGING

Products are to be served and packaged as recommended. Instructions are provided to the customer on storage of items. We will bear no responsibility for incorrect storage or serving of our products whereby food safety is not practised appropriately We reserve the right to have our advertising materials placed upon any packaging provided

INTELLECTUAL PROPERTY / PUBLISHING OF PHOTOS

Sweets By M reserves the right to all photos of their work/products at all times, including publishing such photos in a public manner including social media, website etc.

Sweets By M reserves all rights to their designs, sketches and drawings of works.

Terms and conditions are accepted by the customer by purchasing or making a pre-payment or deposit in person or online.
